These Terms of Service ("Terms") constitute a legally binding agreement between you and Move To Help Foundation ("MTHF," "we," "us," or "our"), a US 501(c)(3) public charity (EIN 83-4130153), governing your access to and use of donate.movetohelp.org (the "Site") and any donations you make through the Site.
By accessing or using the Site, or by making a donation, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Donation Terms. If you do not agree, do not use the Site or make a donation.
We may modify these Terms at any time. Modified Terms become effective when posted on the Site. The "Last Updated" date reflects the most recent revision. Material changes will be communicated through a notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. If you do not agree to modified Terms, stop using the Site.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
Donations made through the Site are governed by these Terms, our Donation Terms, and our Refund Policy. By making a donation, you represent and warrant that:
MTHF is a US 501(c)(3) public charity. Donations are tax-deductible to the extent permitted by US law. Donors outside the US should consult their local tax advisor regarding eligibility for any local tax benefits.
All content on the Site — including text, graphics, logos, images, software, and the design and structure of the Site — is owned by MTHF or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.
You may view, download, and print content from the Site solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent.
If you submit any content to MTHF — including comments, suggestions, photographs, or other materials ("User Content") — you grant MTHF a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display such User Content for any lawful purpose related to MTHF's mission. You represent and warrant that you have the right to grant this license and that the User Content does not infringe any third-party rights.

The Site may contain links to third-party websites, services, or content (such as PayPal, Meta, Google, and Vercel). We do not control, endorse, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are governed by their own terms and privacy policies. MTHF is not liable for any damages arising from your use of third-party services.
While MTHF makes reasonable efforts to ensure the accuracy of information on the Site, we do not warrant that any information is complete, current, or error-free. Statistics, casualty figures, and other crisis-related data are sourced from external organizations (such as the United Nations, OCHA, and others) and reflect the best available information at the time of publication. Field deployment timelines, while based on operational standards, may be affected by factors outside MTHF's control including border closures, conflict escalation, and partner availability.
MTHF's total liability to you for all claims arising from or relating to the Site or any donation, in any form of action whatsoever, shall not exceed the greater of (a) one hundred dollars ($100) or (b) the amount of your most recent donation in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless MTHF, its directors, officers, employees, volunteers, agents, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Before initiating any formal dispute, you agree to first contact MTHF at team@movetohelp.org and attempt to resolve the dispute informally. We will attempt to resolve disputes within thirty (30) days of receipt.
If informal resolution fails, you and MTHF agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your donations through binding arbitration rather than in court, except that you may bring claims in small-claims court if eligible.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Delaware or, at your election, in your county of residence.
YOU AND MTHF EACH WAIVE THE RIGHT TO A TRIAL BY JURY.
You may opt out of this arbitration agreement by sending written notice to team@movetohelp.org within thirty (30) days of first agreeing to these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out.
These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Subject to the arbitration provisions above, exclusive jurisdiction and venue for any actions not subject to arbitration shall be in the state and federal courts located in Delaware.
We may suspend or terminate your access to the Site at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms which by their nature should survive (including disclaimers, limitation of liability, indemnification, and dispute resolution) shall survive.
